Great News for Real Estate

There has been $400,000,000,000 (billion) in real estate foreclosed or sold short (loan not paid in full) since the market turned down.  Another wave of foreclosures will be hitting early next year.  It is estimated there are $300+ billion in mortgage loans still in trouble.  

SO WHAT?

That’s actually good news.  We are more than half way through this melt down!  The real estate market has stabilized and some areas are experiencing appreciation.  Yet, there is still opportunity to buy a home at the discounted price…and 5% interest!

FORECAST:

Real estate prices will continue to increase from the low reached last winter.
Affordability will decrease as interest rates start to rebound to normal levels (7-8%).
It will be extremely important to buy with an eye on reselling.   

Is Forgiven Debt Taxable?

 

QUESTION:  (Brett)  On a short sale, (where a bank is not fully paid) is the forgiven debt taxable income?

ANSWER:  (John)  Technically yes, but most people get an exception and do not have to pay tax on the forgiven debt.   I forwarded this question to my accountant for a more complete and accurate answer.  

 

John,

 Generally, if a taxpayer owes a debt that is canceled or forgiven, the canceled amount is taxable income.  There are exceptions:

 

Bankruptcy – Canceled debt is not included in gross income if the debt is canceled in a bankruptcy case under the U.S. Bankruptcy Code.  The debtor must be under the jurisdiction of the court, and the cancelation of debt must be granted by the court or occur as a result of a plan approved by the court.

 

Insolvency – Canceled debt is excluded from gross income up to the amount by which the taxpayer’s liabilities exceed the fair market value of assets.  This determination is made immediately before the cancelation of debt.

 

A foreclosure or a short sale results in canceled or forgiven debt.  These are treated as a sale or exchange of property.  If this is a primary residence, then the normal rules for exempting the income from taxation come into play.

 

The bankruptcy and insolvency exceptions apply to income resulting from foreclosure or sale of property.

HELP FOR THOSE BEHIND ON HOUSE PAYMENTS

 

I just received the brand new CDPE designation (certified distressed property expert).  A distressed property refers to the condition of the property or the financial condition of the owner.  Did you know that 9.1% of all mortgages are technically in default, that is 30 or more days late on a payment?  Did you know there are multiple options for stressed homeowners…such as mortgage renegotiation, recasting the loan, forbearance, short sale, etc?  I will consult with you or your friends about their options at no charge.  I have helped people avoid foreclosure by renegotiating their loans, getting refinancing and other times I have sold properties and gotten the mortgage company to forgive the deficit.  There are options!

Please forward this to your friends…even your out of state friends.  There are options for people in financial distress.  All they have to do is find a qualified expert.  I will even help them do that in their area of the country.

ATTITUDE CRISES

 

Know someone with an attitude?  I guess we all have an attitude, but I mean a bad attitude or a negative attitude.  They are hard to deal with, eh?  My cynicism is sometimes misinterpreted as negativity.   

Just read a scary article from MSN website which reveals the media’s love for the negative.  I’m not linking you to the article because it’s this kind of stuff that makes a bad situation worse. The  media runs the negative and shocking because that’s what gets people’s attention and without our attention they can’t get our money.   

The article ran on and on about the foreclosure problem.        

Here are the plain facts.  Foreclosures are bad in Ohio, but 97 ¾ % of homeowners are making their payments.  Unemployment is bad too, but 93% of able bodied Buckeyes are employed. 

 This recession in no way compares to the 1929 depression.  It’s not even as bad as the ’79–’82 recession…I know I was there for that one!  The ‘29 depression had 3½ times the unemployment we have now.  Even then 70% of the people had jobs!

So, join me in optimisticizing (I made this word up) America.  Skip the newspapers and the nightly news.  Upgrade your TV time to shows like Andy Griffith and Bonanza.  Read more fishing magazines.  Every time someone says anything negative about the economy or the government respond with two things that are positive about the economy or the government…Okay two things positive about the government may be tough so here are a couple things you can use.  1.) None of our congressmen or senators have had to be laid off.  2.) Gas is a great deal as long as we don’t use much of it!  Okay, I’m being cynical again, but seriously we do live in the best country in the world!  Where else can you make fun of your leaders without losing your head?  

We may not be able to affect the big picture, but we can certainly affect our own little world!  So, go forth and Optimisticize America! 

Renegotiate Your Mortgage

RENEGOTIATION  If you know someone who is struggling under their current mortgage, or a few months late on payments they may still have options.  Some mortgage companies are now renegotiating the loan rather than foreclosing.  They may reduce the principle, reduce the interest rate or a combination of both.  The Feds are putting pressure on mortgage companies to try and keep people in their homes instead of continuing to flood the market with foreclosed homes.  The reasoning is if the lender is going to lose money, why not discount the loan and avoid the expense of foreclosure and keep the home off the market?  Do they really renegotiate?  See the note below.

 “John, you can’t imagine how grateful we are to you!  We were 8 months behind on payments and the sheriff’s sale was scheduled, we figured there was nothing we could do.  We were just hoping you had a quick buyer.  To our amazement, you not only advised us to try and renegotiate our loan, you helped do it!  What can we say?  We know you would have made money to sell our house, but you helped us save our house!  Thank you seems so little, but THANK YOU.’  “Feel free to use this note as a testimony.”
